Cabinet Secretary: There Are Three Types of Bills That Must Be Approved by President

INDUSTRY.co.id - In a bid to issue ministerial, institutional regulations that are more qualified, harmonious, and in harmony with other regulations, the Government has announced that President Joko “Jokowi” Widodo has signed a Presidential Regulation on the Presidential Approval of the Ministerial / Institutional Regulation Bill.
Based on the Presidential Regulation, there are three types of the bills that must be approved by the President, according to Cabinet Secretary Pramono Anung on Tuesday (08/04). Firstly, the bill must have broader impacts for the people.
President Jokowi has told asked all ministries / institutions that if they want to issue regulations that have broad impacts for people, the bills must be approved by the the President. Secondly, the bill is a strategic one.
It means that the bill can affect the President’s priority program, the Government’s targets set in the National Medium-Term Development Plan (RPJMN) and the Government Work Plan (RKP), defense and security, and state finances.
Therefore, the President can give directives about the bill whether it is accepted or rejected. Thirdly, the bill must be in harmony with other regulations that have been issued. Contradictory regulations will cause problems.
Therefore, regulations must be harmonious and connected each other. Based on the Presidential Regulation Number 68 of 2021, before the bill is approved by the President, it must be harmonized, reviewed by Ministry of Law and Human Rights.
After that, the bill will be sent to Secretariat Cabinet. Then, it will be delivered to the President to ask for his approval. If the bill is approved by the President, Cabinet Secretariat will immediately inform the ministry / institution who had previously proposed the bill.
And if the bill is not approved by the President, the bill must be again reviewed and evaluated. The approved bill can be promulgated by Ministry of Law and Human Rights and can become the law of ministry /institution.
The Presidential Regulation Number 68 of 2021 will not extend the bureaucracy process.
“This Presidential Regulation does not aim to extend the bureaucracy process. I have asked the substance deputies of Cabinet Secretariat to help speed up the process if there are problems that occurs,” Pramono said.
On that occasion, Pramono also said that the directives and decisions of the President in the Cabinet Meeting and the Limited Meeting recorded in the minutes of the meeting (MoM) must be reference in making ministerial / institutional regulation bill.
However, he added, it was still not optimally implemented in the first period of the Government cabinet led by President Jokowi.
The issuance of the Presidential Regulation number 68 of 2021 is not only for administrative purposes in making ministerial / institutional regulation bill, but also aims to ensure that all directives and decisions of the President in the Cabinet Meeting and the Limited Meeting are not misinterpreted.
Furthermore, Pramono underscored that all ministries / institutions must understand and carry out this mechanism properly.
