Ministry of Energy and Mineral Resources Publish Five Permen Derived Minerba Act

INDUSTRY.co.id - Jakarta - In order to improve the implementation of mineral and coal mining activities that provide the greatest benefit for the nation and state and to provide certainty in the endeavor, the Ministry of Energy and Mineral Resources simultaneously publishes 5 (five) Decrees of the Minister of Energy and Mineral Resources Kepmen).
This decree is derived from Law No. 4 of 2009 on Mineral and Coal Mining as a legal umbrella of the guidelines for its implementation.
Head of Communications, Public Information and Cooperation Service, Agung Pribadi said the issuance of five new EMR Ministerial Decree is a guideline for the implementation of the Minerba Act as a legal umbrella in the implementation of mineral and coal mining activities so that the company has more legal certainty in the business.
"Legal umbrella in mining activities is very necessary, so as not to arise legal risks in the future," said Agung in Jakarta, Thursday (17/05/2018).
The five decree of the Minister of Energy and Mineral Resources issued, namely, first, the Decree of ESDM No. 1823 K / 30 / MEM / 2018 on Guidelines for Implementation of Imposition, Collection, and Payment / Depositment of Non-Mineral and Coal Mining State. Secondly, the Decree of ESDM Number 1824 K / 30 / MEM / 2018 on Guidelines for Community Development and Empowerment.
Furthermore, the Minister of Energy and Mineral Resources Decree Number 1825 K / 30 / MEM / 2018 concerning Guidelines for Installation of Mining Licenses for Mining Business Licenses or Mining Operations License Areas for Production Operations. Fourth, Decree of the Minister of Energy and Mineral Resources No. 1826K / 30 / MEM / 2018 Concerning Guidelines on Application, Evaluation and Approval of Provision of Metal Mineral Minerals Exportation of Processing And Metal Minerals With Certain Criteria.
Finally, the EMR Ministerial Decree Number 1827 K / 30 / MEM / 2018 concerning Guidelines for the Implementation of Good Mining Engineering Rules and Decree of the Minister of Energy and Mineral Resources No. 1828 K / 30 / MEM / 2018 concerning the Guidelines for Appointed Officials.
In the EMR Ministerial Decree Number 1824 K / 30 / MEM / 2018, the government requires the Company to Establish Guidelines for the Implementation of Community Development and Empowerment consisting of: The Blueprint for Community Development and Empowerment and Guidelines for the Development of Community Empowerment and Development Plans, listed in the format as attached in the Ministerial Decree.
EMR Decree No. 1826K / 30 / MEM / 2018 in addition to regulating the processing result threshold, it is also required to sign an integrity pact containing the obligation to implement the obligation to increase the value added of metal mineral commodities by establishing either own processing and refining facilities or processing and purification cooperation with other parties in accordance with the provisions of legislation and fulfill the obligation of completion of the construction of processing and refining facilities no later than January 12, 2022 and report the development of construction of processing and refining facilities every 6 (six) months.
