Losses From Alleged Corruption RTH Bandung Rp 26 billion

INDUSTRY.co.id - Jakarta - Indication of state losses from corruption allegation cases Land acquisition for Green Open Space (RTH) in Bandung city government in 2012-2013 reached Rp26 billion.

"Estimates of state losses continue to be explored, but the figure is Rp26 billion," KPK chairman Agus Rahardo told a press conference at the KPK building here on Friday. (20/4/2018)

KPK has set three people as a suspect that is Hery Nurhayat as Head of Financial Management and Regional Assets (DPKAD) Bandung, Tomtom Dabbul Qomar and Slamet Level as a member of Parliament Bandung period 2009-2014.

To realize these budgets, APBD Bandung 2012 budget year conducted discussion between Hery with Tomtom and Slamet Level as chairman of the daily execution of budget agencies (banggar) and banggar members.

Appropriate APBD Bandung 2012 passed in the Local Regulation (Perda) Bandung No. 22 of 2012 with the budget allocation for RTH amounted to Rp123.9 billion consisting of capital expenditures of land and supporting expenditures for 6 RTH.

Two RTH among them is RTH Mandalajati with a budget of Rp33, 455 billion and RTH Cibiru with a budget of about Rp80, 7 billion.

"RTH is not fictitious but there is a 'mark up', 'mark up' that causes them to be subjected to the mentioned chapters whose process is less following the rules that apply so that the reason we set the relevant as a suspect," said Agus.

Suspected Tomtom and Level abuse the authority as a team banggar DPRD Bandung city by requesting the addition of the RTH budget allocation, besides both suspected of acting as a broker in land acquisition.

While Hery allegedly misusing authority as a Budget User (PA) by helping the process of liquefying land payments for the RTH when it is known that the payment document does not fit the actual conditions that the sale and purchase transactions of land not to the original landowner but through a broker ie Kadar and friends.

Already examined 72 witnesses since the investigation began that is the civil servant in the environment DPKAD government service of Bandung, former head of Mandalajati, Pasir Impun urban village, ex-lurah Karang Pamulang Mandalajati district, teachers, laborers, private.

Hery is known to be corruption grant prisoners 38 fictitious NGOs that harm the state at Rp8, 1 billion and corruption grants Bandung city administration 2012 who was sentenced for 9 years in prison in 2015 ago. "But this case is different from the previous case," said Agus.

For his actions, Hery, Tomtom and Kadar are considered Article 2 paragraph (1) of Article 3 of Law no. 31 of 1999 as amended by Law no. 20 Year 2001 on Corruption Eradication jo article 55 paragraph (1) to-1 Criminal Code.

The Article regulates the person who violates the law, misuses the authority, opportunity or facilities at his office or position so as to harm the state's finances and economy and enriches himself, another person or corporation with a maximum imprisonment of 20 years in jail for a maximum of Rp 1 billion.
