INDUSTRY.co.id - President Joko “Jokowi” Widodo has signed Presidential Regulation Number 28 of 2021 on the National Cyber and Encryption Agency (BSSN) on 13 April 2021.

The issuance of the Presidential Regulation was based on the need to organize the agency in the context of realizing national cyber security, protection and sovereignty as well as increasing the national economic growth.

“To optimize the implementation of duties and functions in the field of cyber and encryption security, a more effective and efficient BSSN organization is needed,” the Presidential Regulation reads.

This regulation contains, among others, provisions regarding the position, duties and functions; organization; working procedure; and funding.

BSSN is a government institution that is under the authority and directly responsible to the President. This agency has the task of carrying out government duties in the field of cybersecurity and encryption to assist the President in running the government.

In carrying out these tasks, the BSSN carries out the functions of formulating, stipulating, and implementing technical policies in the field of cyber and encryption security, also the preparation of norms, standards, procedures and criteria as well as the implementation of technical guidance and supervision in the field of encryption.

“In carrying out its duties and functions, the BSSN utilizes, develops, and consolidates all elements related to cyber and encryption security,” reads Article 33 of the provisions.

The BSSN organizational structure consists of a head, deputy head, main secretariat, and four deputies.

Deputy I is Deputy for Strategy and Policy on Cyber and Encryption Security in charge of organizing the formulation of technical policies in the field of cyber and encryption security systems and strategies.

Deputy II is Deputy for Cyber and Encryption Security Operations in charge of organizing the formulation and implementation of technical policies in the field of cyber and encryption security operations.

Deputy III is Deputy for Cyber and Encryption ​​Security for the Government and Human Development in charge of organizing the formulation and implementation of technical policies in the field of increasing cyber and encryption security capacity in the Government and human development sectors.

Deputy IV is Deputy for Cyber ​​and Encryption Security for the Economy in charge of organizing the formulation and implementation of technical policies in the field of increasing the capacity of cyber and encryption security for economic sector.

It is further stated in the Presidential Regulation that the Deputy consists of a maximum of four directorates.

Furthermore, to carry out internal supervision in the BSSN, an inspectorate was established as a supervisory element. Apart from the supervisory element, the BSSN may establish a center as an element to support the duties and functions of the BSSN.

Meanwhile, to carry out operational technical duties and / or supporting tasks, the BSSN may establish a Technical Implementing Unit. The establishment of this unit is determined by the Head of the BSSN after obtaining written approval from the minister who is in charge of government affairs in the field of state apparatus.

In addition, there are also functional position groups. “Within the BSSN, a functional position may be assigned according to the needs of which the implementation is carried out in accordance with the provisions of laws and regulations,” Article 32 reads.

Regarding positions, appointments and dismissals, it is stated in this Presidential Regulation that the Head of BSSN is appointed and dismissed by the President and is given financial rights and ministerial level facilities.

“Head of BSSN submits a report to the President regarding the results of the implementation of government duties in the cybersecurity sector periodically or at any time as needed,” reads this Regulation.

Meanwhile, the deputy head, main secretariat, deputy, and functional officers are appointed and dismissed by the President on the recommendation of the Head of BSSN in accordance with the provisions of laws and regulations.

Under this Presidential Regulation, the funding needed to carry out the duties and functions of the BSSN is sourced from the State Budget.

“The organization and work procedures of the BSSN must be established no later than 6 (six) months from the promulgation of this Presidential Regulation,” reads Article 52 of the Presidential Regulation promulgated by Minister of Law and Human Rights Yasonna H. Laoly on 14 April 2021.
