KLHK is not Fair to Handle DL Sitorus Case

INDUSTRY.co.id - Jakarta - Environmental activists and local government officials in North Sumatra questioned the government's stance on land registers management 40. There is an impression of the government in this case, the Ministry of Environment and Forestry (KLHK), not transparent in following up the Supreme Court (MA) decision and not applying the same treatment against the company is suspected to violate the use of land functions.

The Indonesian Forum for Environment (Walhi) believes that there are many things that KLHK hides in relation to the prosecution of companies managing land in register 40. After the death of Derianus Lungguk Sitorus (DL Sitorus), one of the planters from Medan, North Sumatra, is poor execution and not transparent in describing the results of land execution set by MA.

Dana Tarigan, Executive Director of Walhi Sumatera Utara, requested KLHK to take action against all companies in register 40 fields using the land but not in accordance with the allocation. This needs to be done in order to demonstrate the government, to act justly not just to take action against one company, PT Torganda (company owned by DL Sitorus), but other companies also include State-Owned Enterprises (BUMN).

"We have to say that, all the wrong companies should be dealt with and treated the same in the register land 40. If there is a community-managed, then it includes agrarian reform to be distributed to the community. If any company manages illegally, the land must be taken by KLHK to be returned to the country in a reforested condition. Do not let the government out of money (to reforest), it is also not fair," said Dana in his statement received by the Editor Wednesday (13/09/2017).

There are 29 companies controlling Register 40 land, PT FMP of 14,853 hectares, PT Wonorejo with 7,892 ha, PTPN IV 10,000 ha, PT SSPI 5,500 ha, Bukit Harapan Cooperative (executed) 23,450 ha, KTPS 14,000 ha, PT AML 21,000 he , Koperasi Langkimat 14.000 ha, PT SSL 33,390 Ha, PT EPS 9,833 Ha, PT KM 2,000 ha, PTPN II 10,000 ha, PT Rapala 10,300 Ha, PT Inhutani IV 19,500 Ha.

 Then there is also Parsub 17.000 ha, Community Group 10.000 ha, KUD Sinar Baru 3000 ha, KUD Serba Guna 3000 ha (already have certificate), Cooperative KPN 1,500 ha, PT Rispa 5,000 ha, Transmigration 7,135 ha, PT SKL 82.502 ha, PT CP 2,000 ha, PT MAI 10,781 Ha, PT KAS 4,870 Ha, PT HBP 4,000 ha, PT AMKS 4,500 Ha, PT AMKS 4,500 ha, PT Germany 300 ha.

 But lately only sticking out cases of land 47 thousand ha, land owned by company DL Sitorus. This then led to the reaction of many parties, and questioned the reasons of the KLHK which only questioned DL Sitorus, who subsequently died on 3 August 2017 inside the Garuda Aircraft.

Dana added that KLHK is not transparent in money management from ransom given by the company that manages the land in register 40. According to its calculation, the amount of funds is estimated to reach Rp 7.8 trillion and the fund must be accountable to the public.

 "The order of the Supreme Court's decision in execution is all, and then the company is given one cycle cropping time, and then reforested. Well, the money that one planting cycle should be returned to the country. If according to our calculation has reached Rp 7.8 trillion, who is pengang," said Dana.

 Dana asserted, if the money has not been paid by PT Torganda (company owned DL Sitorus) then the government should ask for the money. If not according to him, there is a loss experienced by the state and raises the suspicion that the money is distributed to the unscrupulous.

 Based on Supreme Court Decision No. 2642 / K / PID / 2006, which has been enforced and decided DL Sitorus, guilty of controlling the state forest, through its company, PT Torganda and PT Torus Ganda? The cassation decision states; First, oil palm plantations covering an area of ​​± 23,000 ha, which is controlled by Plantation Cooperation of Palm Oil at Bukit Harapan and PT. Torganda, along with all the buildings that were there, was seized for the state through the Ministry of Forestry.

 Meanwhile, Sutrisno Pangaribuan, a member of Commission C of North Sumatra DPRD, considers the Ministry of Environment and Forestry to discriminate against DL Sitorus planters.

 "We have suggested to be completed all of this means that not only DL Sitorus company [PT Torganda] .There are dozens of companies there, whether private or state-owned, we say many times, why only Mr. Sitorus DL is executed by the AGO," said Sutrisno.

The PDI-P politician found about 29 oil palm plantation companies in Reg area 40 during a field visit. He questioned why only Koperasi Bukit Harapan and KUD Serba Guna under PT Torganda were hunted by KLHK.

 "Do not know why this is treated differently with him (DL Sitorus)," he said.

Separately, Aripay Tambunan, a member of North Sumatra National Mandate Fraction Commission, said that the death of plantation entrepreneurs from North Sumatra DL Sitorus opened the fact that KLHK did not succeed in creating a fair and transparent competition climate for entrepreneurs in the field of plantation. KLHK focuses only on one company among the troubled companies in the register field 40.

 "If the government wants to be firm it should be that all companies or entrepreneurs doing business in land register 40 are dealt with forcefully if they violate the rules. Why only DL Sitorus companies are dealt with and exposed all-out," said Airpay.

 According to Aripay, as a regulator of the Ministry which is led by Siti Nurbaya should be in a neutral position, not in favor of certain interests. The treatment of DL Sitorus is so assertive, but not done to other entrepreneurs. This can be perceived as an unfair action by the businessperson. In the end, the business actor considers the government to accommodate only the interests of the program.

 He stressed, Minister Siti Nurbaya, should be able to explain clearly to the public who are the parties who do not meet the requirements of managing the land in the Register 40. "To be fair, everything is treated equally and the public can judge that many are making mistakes," he added.
