INDUSTRY.co.id - Jakarta - The Attorney General's Office appoints former President Director of PT Pertamina (Persero) Karen Galaila Agustiawan as a new suspect (TSK) in a corruption case related to the company's investment in the Australian Basker Manta Gummy Block (BMG) 2009 which cost the state finance to Rp 568 billion.

Head of the Law Information Center of the Attorney General's Office M Rum in Jakarta, Wednesday (4/4/2018) to the media crew declared the determination of Karen as a suspect based on the Order of Determination of Suspects of the Director of Investigation at the Deputy Attorney General for Special Crimes Number: Tap-13 / F.2 /Fd.1/03/2018 of 22 March 2018.

He added that the prosecutor's office also appointed Chief Legal Councel and Compliance Pertamina Genades Panjaitan (GP) as a suspect based on the Order of Determination of Suspect Director of Investigation on Junior Attorney General Special Crimes Number: Tap-14 / F.2 / Fd.1 / 03/2018 March 22, 2018.

Meanwhile, former Finance Director of Pertamina, Ferederick Siahaan (FS) is designated as a suspect based on the Order of Determination of Suspect Director of Investigation on Junior Attorney General for Special Crimes Number: Tap-15 / F.2 / Fd.1 / 03/2018 dated March 22, 2018.

The prosecution entrapped them using Article 2 paragraph (1), Article 3 of Law Number 31 of 1999 as amended by Law Number 20 Year 2001 regarding Amendment to Law Number 31 Year 1999 concerning the Eradication of Corruption jo. Article 55 paragraph (1) to the 1st Book of the Criminal Law.

"Up to now, 67 witnesses have been questioned by investigators," he said.

The Attorney General's Office has also appointed BK, former Director of Mergers & Acquisitions (M & A) of Upstream Directorate of Pertamina, as a suspect based on the Order of Determination of Suspects of the Director of Investigation of the Special Prosecutor General for Special Crimes Number: TAP-06 / F.2 / Fd.1 / 01 / 2018 January 23, 2018.

The case started in 2009, when Pertamina acquired (Non-Routine Investment) in the form of ROC Oil Company Ltd's purchase of some of the assets (Interest Participating / IP) in the Australian Basker Manta Gummy (BMG) field under the Agreement for Sale and Purchase-BMG Project date May 27, 2009.

In the implementation, there are allegations of irregularities in the proposed investment that are not in accordance with investment guidelines in making investment decisions without any feasibility studies in the form of a complete review or Final Due Diligence and without the approval of the Board of Commissioners.

As a result, the allocation and use of funds amounting to USD 31,492,851 and other expenses incurred amounting to USD 26,808,244 did not provide benefits or profits to Pertamina in order to increase national oil reserves and production which resulted in state financial losses cq. Pertamina amounting to USD 31,492,851 and USD 26,808,244 or equivalent to Rp 568.066.000.000 according to the calculation of Public Accountant.
