Bawaslu RI Requested to Cancel Mathius Awoitauw As Candidate for Bupati Jayapura

INDUSTRY.co.id - Jakarta - Candidate Regent of Jayapura Serial Number 2 Mathius Awitauw (petahana candidate) is threatened to be canceled as Regent Candidate related to his action to replace some officials in the Local Government of Jayapura Regency which is contradictory to Article 71 paragraph (2) of Law no. 10 Year 2016.
A number of officials replaced namely; Head of Industry and Trade Office through Decision Number: SK.821.2.09-09, Head of Industry at the Department of Industry and Trade through Decision Number: SK.821.2-40 and Director of RSUD Yowari through Decision Number: SK.821-2-10 on dated August 29, 2017. The act of dismissal and replacement of such officers has been contradictory to the provision of Article 71 paragraph (2) of Law no. 10 of 2016 stating that the Governor or Deputy Governor, Regent or Deputy Regent and Mayor or Deputy Mayor are prohibited from doing the replacement of officials’ 6 (six) months before the date of appointment of candidate pairs until the end of term of office unless approved by the Minister. In paragraph (5) affirms that if the Governor or Deputy Governor, Regent or Vice Regent and Mayor or Vice Mayor as petahana overlies the provisions as referred to in paragraph (2) and paragraph (3), the petahana shall be subject to sanction of cancellation as a candidate by the Provincial KPU or Regency / Municipal KPU.
According to the candidate of Regent Number 3 Godlief Ohee, Mathius Awitauw as Regent of Jayapura who is also the Regent Candidate Candidate Number 2 shall not make any termination / replacement of officers since his term of office expired on October 5, 2017, thus clearly violating Article 71 paragraph 2) Law no. 10 of 2016 which prohibits petahana candidates from dismissal / replacement of officials 6 (six) months prior to appointment as candidate until the end of term of office. Therefore I have reported this case to Bawaslu RI on 15 September 2017 accompanied by evidence and Bawaslu RI has followed up by requesting my information as a complainant and other witnesses.
I think this is a serious violation that must be processed in accordance with the prevailing laws and regulations and I ask the Bawaslu RI to issue the recommendation of the relevant cancellation as a candidate for the Bupati of Jayapura as stipulated in paragraph (2) of Article 71 above, since this is the law order then everyone shall be subject to the law, nothing shall be privileged or immune. This problem is very simple, the evidence is clear, the event is clear and the norm is also very clear that it does not need a long-winded process. The replaced official a few days ago had come to the Ministry of Home Affairs to report the matter, and one official at the Ministry of Home Affairs declared that the dismissal was not through the Minister of Home Affairs' approval.
So I think it is very clear that the change of government officials of Jayapura Regency has fulfilled the violation of Article 71 paragraph (5) of Law no. 10 of 2016 so that the status of Mathius Awitauw as a Regent Candidate should be canceled as stipulated in paragraph (2) of Article 71.
All the stages in this election have been regulated in legislation, what can be done and what not to do, and this must be obeyed by all candidates. As a candidate for an independent path, I have since attempted to comply with all applicable rules of the game to qualify as a candidate. So there should be no other candidates who just tossing the rules casually, including prospective petahana. All candidates must be treated equally before the law; this should be the concern of Bawaslu RI.
That I reported the case to Bewail RI because the Provincial Bawaslu is no longer neutral in conducting surveillance. Many violations were reported by other candidates but raw in the provincial Bawaslu for various reasons. This also causes the Provincial Chair and Member of the Provincial Bawaslu to face the DKPP meeting for not following up on the massive C1 holographic counterfeiting report reported by other candidates.
Therefore, as a Reporting Party, I hope Bawaslu RI really shows the professionalism and integrity as the national responsibility of election supervision. The elections of Jayapura Regency can be said to run democratically and according to the rules or not, are highly dependent on supervisory institutions. If the supervisory institutions come into play, then democracy and the law will be broken. But I believe and believe, the commissioners Bawaslu RI is a figure who has capacity, capability and integrity that no doubt.
It is worth noting that the Pilkada of Jayapura Regency held on February 15, 2017 has been halted due to the finding of structured and massive violations that led to the Recommendation of Jayapura District Supervisory Committee to conduct PSU in 229 out of 348 polling stations spread over 19 districts. The PSU itself was delayed for 6 months and was only implemented on 23 August 2017 in 261 TPS by the Provincial KPU.
