INDUSTRY.co.id - Jakarta - Former member of Commission II of the House of Representatives Miryam S Haryani was sentenced to five years imprisonment and a fine of Rp200 million subsidies for three months in jail for committing a criminal act of corruption in the form of giving false information in the trial of corruption case of electronic ID card.
"Trial, declared the defendant Miryam S Haryani proven to commit a criminal act of corruption is by giving unlawful information," said judge chairman Frangki Tumbuwun in court in Corruption Crime (Corruption) Jakarta, Monday (13/11/2017)
The verdict was lower than the KPK Prosecutor's request that Miryam be sentenced to eight years imprisonment plus a fine of Rp300 million subsider six months.
"The defendant intentionally did not provide the correct information when the obligation for the witness was to give correct information. The information is considered false information if it is not in accordance with the actual reality. From those revealed in the trial, that the defendant on Thursday, March 23, 2017 filed as a witness, was sworn in," said a member of the judges' panel Anwar.
At that time Miryam was sworn in as a witness for the trial of the accused former Director General of Population and Civil Registration (Dukcapil) Kemendagri Irman and former Director of Information Management Administration of Population (PIAK) Kemendagri Sugiharto in the case of corruption KTP-Electronic.
Miryam revoked his BAP which explains, among other things, the receipt of money from Sugiharto on the grounds that the investigation has been suppressed and threatened by 3 KPK investigators while the reason of the defendant was not true.
The information is contained in BAP December 1, 2016, BAP dated December 7, 2016, BAP dated December 14 and BAP dated January 24, 2017 signed and signed by Miryam.
Furthermore, on Thursday, March 30, 2017, the Public Prosecutor presented Miryam at the trial along with 3 investigators, Novel Baswedan, MI Susanto and Ambarita Damanik. After taking the oath of three oral verbal witnesses, the judge informed the KPK investigators of the pressures and threats made to the defendant during the investigation as described in the previous trial.
"The investigator stated that he had never insisted and threatened but the defendant still felt pressured and threatened by the investigator and forced to sign the BAP and declared the BAP to be revoked as witnesses that the defendant who said the pressure was inversely proportionate to what the three investigators said or lunch, given the opportunity to read and correct reading," Anwar added.
At the next hearing was given an opportunity to Miryam for advanced examination that is by examining the video recording examination as much as 4 times that filed as electronic evidence.
"A psychological analysis was conducted to determine the presence of stressful conditions and by forensic psychology teams and forensic associations showed no pressure due to many short investigators' questions and answered a length of time. The expert said it can be concluded that no pressure was found, but in the case of denying it as a true testimony then indicates there is an indication of a lie that the defendant's statements given during the investigation that said to be pressured and threatened were untrue information, "Anwar said.
That is, according to the judge, the statement of Miryam who denied receiving the money was inversely related to what Irman, Sugiharto, Yosef Sumartono and Vidi Gunawan said were giving 100 thousand US dollars, 100 thousand US dollars, 500 thousand dollars and Rp5 billion. Money was delivered by Sugiharto to Miriam's house.
On the verdict, Miryam expressed his thoughts, but he objected to the verdict.
"I personally mind, I will think with my lawyer team, I will not be sentenced to five years, so I suspect," said Miryam.
While the KPU KPU also expressed a thought for seven days. (Ant)
